Terms of Use

These Terms of Use (the “Terms,” and the End-User License Agreement, or “EULA”) govern your use of the MyTalisman mobile application and website. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use MyTalisman.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent where you live, if higher) and able to form a binding contract to use MyTalisman. By using the app you represent that you meet these requirements.

2. Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use MyTalisman on a device you own or control, for your own non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except where the law permits.

3. What MyTalisman is (and is not)

MyTalisman is a tool for reflection, intention-setting, and personal ritual. It draws on historical symbolic traditions and on honest psychology — meaning, attention, emotion, action, and repetition. It works by helping you focus your attention and follow through on your own real-world actions.

4. Acceptable use

You agree not to use MyTalisman to: break the law; infringe others’ rights; attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the service; or otherwise misuse the app in any way that could harm us or the service. MyTalisman is a private, single-user app: the content you create is visible only to you and is not shared with, or discoverable by, other users.

5. Your content

You own the intentions, words, and personal details you create in MyTalisman. You grant us a limited licence to host, process, and display that content solely to operate the app for you — including sending the necessary details to our image provider to generate your talisman (see the Privacy Policy). You are responsible for the content you submit and confirm you have the right to submit it. You can export or delete your content at any time in the You tab.

6. Our content and trademarks

The app, its design, the celestial mark, generated emblem styling, text, and software are owned by MyTalisman or its licensors and are protected by intellectual-property laws. References to external books and research on our site and in the app are provided for attribution and further reading only and do not imply any endorsement by, or affiliation with, those authors or publishers.

7. Disclaimers

MyTalisman is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any particular result will be achieved. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

8. Limitation of liability

To the fullest extent permitted by law, MyTalisman and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the app. To the extent we are found liable, our total liability will not exceed the greater of the amount you paid us in the twelve months before the claim, or US $50. Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

You may stop using MyTalisman and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service. Sections that by their nature should survive (such as content licences, disclaimers, and limitation of liability) will survive termination.

10. Apple and app stores

If you obtained MyTalisman from the Apple App Store, the following applies:

• These Terms are between you and MyTalisman only, not with Apple. Apple is not responsible for the app or its content.
• Your licence to use the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• To the extent permitted by law, any product warranty is our responsibility, not Apple’s; if the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation.
• We, not Apple, are responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, and intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you obtained the app from Google Play or another store, that store’s terms also apply to your download.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the developer is established, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of its competent courts, except where mandatory local consumer-protection law gives you additional rights.

12. Changes

We may update these Terms as the app evolves or the law changes. We will revise the “Last updated” date and, for material changes, provide a more prominent notice. Your continued use after an update means you accept the revised Terms.
